1 - Purpose and acceptance of the general conditions
The evoleum.fr website (hereinafter referred to as the "Site") is an e-commerce site accessible via the Internet at www.evoleum.fr. It is open to any user of this network (hereinafter referred to as "User"). It is published by the company SANOFIRM, whose commercial name is Evoleum, SAS with a capital of €50,000, domiciled at 59 boulevard Exelmans 75016 Paris and registered in the Paris Trade and Companies Register under the number: 498 316 314 R.C.S. The Site enables Sanofirm to offer beauty and well-being products and food supplements for sale to Internet users browsing the Site (hereinafter referred to as "Users"). For the purposes of these terms and conditions, it is agreed that the User and Sanofirm shall be collectively referred to as the "Parties" and individually referred to as the "Party", and that the User who has validated an order shall be referred to as the "Buyer". The rights and obligations of the User necessarily apply to the Buyer.
2 - Products marketed on evoleum.fr
All the products offered on the Site are available worldwide.
The buyer may, prior to placing an order, take note of the essential characteristics of the product(s) he/she wishes to order on the Evoleum website.
Purchase offers, including promotional offers, are valid as long as they are announced on the Site.
Any order for a Product offered on the Site implies consultation and express acceptance of these general terms and conditions of sale, without this acceptance being conditional on a handwritten signature by the User.
It is specified that the User may save or print these general terms and conditions of sale, provided that they are not modified. These general terms and conditions of sale are valid from 01/09/2015. Sanofirm reserves the right to modify these General and Specific Conditions of Sale at any time, without prior notice, it being understood that such modifications will be inapplicable to reservations and orders previously accepted and confirmed by the Buyer. These conditions apply to the exclusion of any other document.
3 - Prices of products on sale on the site
The prices appearing on this Site are indicated in Euros, all taxes included, and may vary during the year, it being understood that the products ordered are invoiced at the prices in force when the order is registered.
They include shipping costs if they are shipped within France. For all orders placed outside France, shipping costs will be invoiced in addition to the price of the products purchased. The shipping costs will be indicated before the order is placed by the buyer.
The prices of the products include the value added tax (VAT: 5.5%) applicable on the day of the order and any change in the applicable rate will automatically be reflected in the price of the products sold by Sanofirm on its Site.
4 - Ordering
Any order implies full and unreserved acceptance of these general terms and conditions of sale.
The Buyer accepts that Sanofirm's order registration systems are proof of the nature of the agreement and its date.
The amount of each order is limited to the sum of 500 euros per order. When the order is confirmed by clicking on the "Complete order" button, the Buyer declares that he/she accepts the order and these general terms and conditions of sale. The order form can be printed.
As soon as the order is registered, a detailed acknowledgement of receipt of the order will be sent to the Buyer at the e-mail address he/she has indicated.
This acknowledgement of receipt will specify the exact amount invoiced and the terms of delivery of the order.
This acknowledgement of receipt is equivalent to acceptance of the order and will validate the transaction subject to payment of the order.
In the event of unavailability of one or more products after the order has been placed, the Buyer will be informed by e-mail. The amount of the order will be recalculated and the Buyer will be debited with the new amount, less the missing products. If the order is completely unavailable, the Buyer will be notified by e-mail and will not be debited.
The Buyer may also cancel an order placed on the site by contacting customer service at +33 1 47 55 43 72. If customer service confirms that the order has already been processed, it cannot be cancelled: the Buyer must then refuse the package when receiving the order.
However, Sanofirm reserves the right to suspend or cancel any order from a Buyer with whom there is a dispute relating to the payment of a previous order, or for any other legitimate reason relating in particular to the abnormal nature of the order.
5 - Payment
All orders are payable in euros.
To pay for his order, the Buyer has the following payment methods:
Bank cards. The following credit cards are accepted on the Site: Visa, Master Card and Carte Bleue.
Payments via the Paypal service.

The Buyer guarantees Sanofirm that he/she has the necessary authorisations to use the world of payment he/she will have chosen, at the time of the registration of the order form.
Sanofirm reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment of any sum due by the Buyer or in the event of a payment incident.
Penalties of an amount equal to the legal interest rate increased by five points are automatically applicable to unpaid amounts at the end of a period of ten days following the date of the invoice.
As part of the fight against Internet fraud, information relating to your order may be transmitted to any competent authority for verification.
In order to ensure the security of payment by bank card, the Buyer must send Sogenactif the visual cryptogram (CVV) of their bank card.
The security of payment on the Site is also ensured by Sogenactif.
6 - Delivery of orders
The products will be delivered to the address indicated by the Buyer on the order form, according to the method of delivery chosen among those described in the page Shipping / Delivery. Delivery will be made within an average of 2 to 7 days from receipt of the order form, depending on the delivery method chosen, and within a maximum of 30 days from receipt of the order form.
7 - Legal guarantee
The Buyer benefits from the provisions of the legal guarantee of conformity and the legal guarantee of hidden defects.
In the event of a lack of conformity of the product, in particular due to an anomaly or an error in the references delivered, the Buyer may choose to return the product to Sanofirm and obtain reimbursement.
Sanofirm will reimburse the cost of return at the request of the Buyer. For any complaint, the Buyer may contact Sanofirm at the following address: contact[at]evoleum.fr.
8 - Right of withdrawal
The Buyer has a period of 14 clear days from the date of receipt of the product to return the ordered products for reimbursement at his/her expense.
The reimbursement will be made by any means of payment chosen by the Buyer after the exercise of his/her right of withdrawal, at the latest within 14 days following the date on which the right is exercised (upon receipt of the returned order or of the proof of shipment of the returned product).
9 - Instructions for returning products
Products may be returned by the Buyer under the conditions and according to the instructions below:
We accept the return of any item purchased on the Site if it is returned within 14 days from the date of receipt of the order by the Buyer.
The refund will be for the full amount paid at the time of purchase, including delivery costs. It should be noted that, in accordance with Article L 121-21-4 of the French Consumer Code, only standard delivery costs will be taken into account, the amounts corresponding to express or special deliveries will not be taken into account.
The Buyer is responsible for the shipping costs of the return package. In the case of a technical anomaly or an error on the references delivered, the return costs will be reimbursed.
The product must be intact, in its original condition, in its packaging, with its accessories and instructions. It must not have been used.
If a box or set is returned, it is imperative that the entire box or set be sent.
Whatever the reason for returning the products to Sanofirm, the Buyer is advised to follow the following instructions in order to facilitate the processing of the said return:
- Use the original unopened product packaging to return the product.
- Complete and attach the Return Form to be detached from the Delivery Form.
- Send the package to the following address Evoleum / Sanofirm, Customer Service - Merchandise Return, 59 boulevard Exelmans 75 016 Paris.
All risks related to the return of the product are at the Buyer's expense.
10 - Reservation of ownership
Sanofirm retains full ownership of the products sold until full payment has been received, including all costs and taxes.
11 - Liability
Sanofim cannot be held responsible for the non-execution of the contract in the event of a stock shortage, except in the case of a price promotion not intended to clear stocks, or in the event of the unavailability of the product due to a case of force majeure.
Sanofim declines all responsibility:
for any interruption of the Site,
for any occurrence of bugs,
for any damage resulting from fraudulent intrusion by a third party leading to a modification of the information made available on the Site,
and more generally for any direct or indirect damage, whatever the causes, origins, and more generally any direct or indirect damage, whatever the cause, origin, nature or consequences, including in particular the loss of profits, customers, data or any other loss of intangible assets that may arise as a result of anyone's access to the Site or the impossibility of accessing it, or the credit given to any information coming directly or indirectly from the latter.
12 - Intellectual property
All the elements, trademarks, designs, models, photographs, texts, illustrations, logos, animated or not, sound or not, graphics, etc. found in this Site as well as their compilation are the exclusive property of evoleum.fr and are protected by the laws governing the ownership of literary and artistic rights or other similar rights, which do not grant any license or any other right than that of consulting the Site.
The reproduction or use of all or part of these elements is only authorised for the exclusive purpose of information for personal and private use, any reproduction or use of copies made for other purposes being expressly prohibited. Neither the Site, in whole or in part, nor its content, nor the trademarks may be used, reproduced, duplicated, copied, sold, resold, made accessible, modified or exploited in any other way, in whole or in part, for any purpose whatsoever, without the prior written authorisation of Sanofirm.
Any other use constitutes an infringement.
13 - Applicable law
Sales of Sanofirm products are subject to French law.
14 - Information technology and freedom
The information collected is processed for the purpose of sending a newsletter and/or managing the Buyer's order.
The recipients of the data are Sanofirm and its service providers.
The Buyer has the right to access, rectify, oppose and delete data concerning him/her by sending an email to contact[at]evoleum.fr.
The Site is registered with the CNIL under number 24780 v 0.
